Terms of Use

Agreement

These Terms of Use govern your use of the Shuffly iOS application (“the app”), made by BQKode, Norway (“we”, “us”). By downloading or using the app you agree to these terms. If you do not agree, do not use the app.

These terms apply alongside Apple’s standard Licensed Application End User License Agreement. Where these terms are silent, Apple’s EULA applies.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Shuffly on Apple devices that you own or control, in accordance with the App Store terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the app except where the law expressly permits it.

Fair use of randomness

Shuffly produces randomised and fairness-balanced outcomes for fun, sports, games, and everyday decisions. It is not a certified random number generator and must not be used for gambling, lotteries with monetary stakes, legally binding draws, or any context where a certified or auditable source of randomness is required.

Your content

Names, groups, scores, and other content you enter into Shuffly stay on your device and remain yours. You are responsible for the content you enter and for having the right to enter it (for example, other people’s names).

Purchases

Shuffly is free to download and includes a number of free sessions. Once those are used, running a session in most modes requires credit, which you can get in two ways: a one-time “Shuffly Pro” unlock for unlimited sessions, or a consumable session pack. Dice and Finger Pick are always free and never use a session. What counts as a session, and the current free allowance, are described on our FAQ.

All purchases are processed by Apple and are subject to Apple’s payment and refund policies. Prices are shown in the App Store before you buy. The “Shuffly Pro” unlock is a non-consumable purchase tied to your Apple ID; use “Restore Purchases” to reinstate it on a new device, and it can be shared through Family Sharing. Session packs are consumable: their remaining balance is kept on your device and synced across your own devices through iCloud, so it is not re-downloaded via “Restore Purchases”.

No warranty

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted or error-free. Match, score, and statistics features are aids for informal use, not official records.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app or in-app purchases in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

Apple

These terms are between you and BQKode, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes and termination

We may update the app and these terms from time to time; the “Last updated” date above reflects the current version. Continued use after a change means you accept the updated terms. We may terminate this license if you materially breach these terms.

Governing law and contact

These terms are governed by the laws of Norway, without prejudice to mandatory consumer protections in your country of residence. Questions? Email hello@shufflyapp.com.
